Este trabalho analisa a influência tributária na definição do modelo constitucional de atribuição dos resultados econômicos da exploração do petróleo offshore, no Brasil. Além da abordagem constitucional do tema, destaca-se a participação dos entes federativos estaduais nas rendas da produção de petróleo, sua federalização e, em decorrência, a redução das rendas dos entes federativos subnacionais, implicando num movimento compensatório pela via da utilização de elementos de natureza tributária, tais como o extinto Imposto Único sobre Minerais e o regime constitucional especial (...) de cobrança na origem do ICMS devido nas operações de combustíveis e derivados de petróleo. This article investigates how the oral tradition practices of griôs in the Northeast of Brazil can be used as sources of information. This is an exploratory study based on bibliographic and documentary techniques, which used semi-structured interviews as a data collection tool. The data was analyzed using pragmatic language analysis. Through the interviews, we identified oral tradition as a source of information that, taken as an object of study, requires a decolonial approach. We observed a variety of oral tradition practices (...) from the interviewees that are sources of information, namely: storytelling, games, dance, musicality and martial arts. The conclusion is that Griô oral tradition practices can be used as sources of information in which the local history and culture of a community are the informational genesis, based on interactions between people. O tema é discricionariedade nas teorias do positivismo antes e depois de Dworkin desde a crítica hermenêutica do direito e sua teoria da decisão. O problema é: há a possibilidade de uma teoria da decisão no positivismo, seja ele qual for, mantendo-se intactos os seus princípios metodológicos da descrição e da separação entre direito e moral? O objetivo é apresentar a crítica hermenêutica do direito e sua oposição à discricionariedade dos positivismos. A conclusão é a de que a crítica hermenêutica (...) não é apenas negativa com relação aos positivismos, ela é também positiva e construtiva de uma teoria da decisão. (shrink)

O presente trabalho objetiva fazer uma análise sobre algumas das principais temáticas elaboradas pelo pensador argentino Luis Alberto Warat, quais sejam: o antropofagismo waratiano, o reencontro com a subjetividade perdida e a carnavalização. Para isso, analisou- se uma das obras mais caras do pensamento waratiano: A ciência jurídica e seus dois maridos. Buscou-se através da análise empreendida, elaborar uma crítica sobre paradigmas tradicionais de ciência, incluindo aqui, a própria Ciência do Direito. Sobreleva-se o caráter de indisciplina das atividades artístico-literárias para (...) insinuar as falhas históricas das disciplinas bem instituídas, do pensamento e da cultura dominantes. IntroductionHistory of depression symptoms, including before and during pregnancy, has been identified as an important risk factor for postpartum depression symptoms. This condition has also been associated with diverse implications, namely, on the quality of mother–infant bonding. Moreover, the role of self-criticism on PPD has been recently found in several studies. However, the link between these factors has not been explored yet. Furthermore, anxiety symptoms in postpartum has been less studied.MethodsThis study analyzed whether the history of depression symptoms predicted mother–infant (...) bonding, via self-criticism and PPD symptoms. The same model was repeated with a history of anxiety and postpartum anxiety symptoms. A total of 550 mothers of infants <24 months old participated in this cross-sectional study and answered an online survey.ResultsThrough a parallel–serial mediation model, the results show that in a first step, self-criticism dimensions of inadequate-self, hated-self, and reassuring-self, and in a second step, PPD symptoms, mediate the relationship between the history of depression symptoms and mother–infant bonding. However, the relationship between the history of anxiety symptoms and bonding is not mediated by all the considered chain of mediators, being only mediated by one of the self-criticism dimensions, inadequate self.ConclusionsThe current study confirmed the association of history of both depression and anxiety with mother–infant bonding. While in the case of history of anxiety symptoms, the relation was only mediated by inadequate self-dimension of self-criticism, in the case of history of depression symptoms, the relation was mediated by self-criticism and postpartum depressive symptoms. The buffering effect of reassuring-self on bonding and negative affect was also evidenced. Psychological and preventive interventions should address this evidence to target interventions for mother–infant bonding problems in accordance with previous and actual current maternal risk factors. Two famous negative results about da Costa’s paraconsistent logic ${\mathscr {C}}_1$ (the failure of the Lindenbaum–Tarski process [44] and its non-algebraizability [39]) have placed ${\mathscr {C}}_1$ seemingly as an exception to the scope of Abstract Algebraic Logic (AAL). In this paper we undertake a thorough AAL study of da Costa’s logic ${\mathscr {C}}_1$. On the one hand, we strengthen the negative results about ${\mathscr {C}}_1$ by proving that it does not admit any algebraic semantics whatsoever in the sense (...) of Blok and Pigozzi (a weaker notion than algebraizability also introduced in the monograph [6]). On the other hand, ${\mathscr {C}}_1$ is a protoalgebraic logic satisfying a Deduction-Detachment Theorem (DDT). We then extend our AAL study to some paraconsistent axiomatic extensions of ${\mathscr {C}}_1$ covered in the literature. We prove that for extensions ${\mathcal {S}}$ such as ${\mathcal {C}ilo}$ [26], every algebra in ${\mathsf {Alg}}^*({\mathcal {S}})$ contains a Boolean subalgebra, and for extensions ${\mathcal {S}}$ such as,, or [16, 53], every subdirectly irreducible algebra in ${\mathsf {Alg}}^*({\mathcal {S}})$ has cardinality at most 3. We also characterize the quasivariety ${\mathsf {Alg}}^*({\mathcal {S}})$ and the intrinsic variety $\mathbb {V}({\mathcal {S}})$, with,, and. (shrink)

We present a new infinite family of finite-valued paraconsistent logics—whose _n_-th member we call _Sette’s logic of order_ _n_ and denote by ${\mathscr {S}}_n$ —all of which extending da Costa’s logic ${\mathscr {C}}_1$ and extended by classical logic $\mathcal {C\!\hspace{0.0pt}L}$. We classify the family $\{ {\mathscr {S}}_n: n \ge 2 \}$ within the Leibniz hierarchy by proving that all its members are finitely algebraizable. We also prove a completeness theorem for each logic ${\mathscr {S}}_n$ wrt. a single logical matrix (...) and characterize the quasivariety ${\textsf{Alg}}^*({\mathscr {S}}_n)$. Finally, we consider the infimum of the family $\{ {\mathscr {S}}_n: n \ge 2 \}$ and prove that unlike Sette’s logic of any given finite order, the logic ${\mathscr {S}}_\infty = \bigcap _{n \ge 2} {\mathscr {S}}_n$ is not finitary. Furthermore, we establish a completeness result for the logic ${\mathscr {S}}_\infty$ as well as characterize the generalized quasivariety ${\textsf{Alg}}^*\big ( {\mathscr {S}}_\infty \big )$. Externalism about artifactual words requires that (a) members of an artifactual word’s extension share a common nature, i.e. a set of necessary features, and (b) that possession of such features determines the word’s extension independently of whether the linguistic community is aware of them (ignorance) or can accurately describe them (error). However, many common artifactual words appear to be so used that features that are universally shared among members of their extensions are hard to come by, and even fewer can (...) be plausibly regarded as necessary; morevoer, it is highly doubtful that a speaker could manage to refer to kind A while being utterly ignorant of the role the As play in the A-producing community, and it is no less doubtful that an artifactual word that was used to refer to certain objects would keep referring to them (and be regarded as having referred to them) once it has been shown that the associated description is utterly false of such objects, the reason being that we could easily make things that do fit the associated description. Against generalized externalism, it is suggested that artifactual words come in (at least) three different semantic varieties: a few have an externalist semantics, others have an internalist semantics, still others have neither but rather behave as “family names” in Wittgenstein’s sense. In On Certainty, Wittgenstein addressed the issue of beliefs that are not to be argued for, either because any grounds we could produce are less certain than the belief they are supposed to ground, or because our interlocutors would not accept our reasons. However, he did not address the closely related issue of justifying a conclusion to interlocutors who do not see that it follows from premises they accept. In fact, Wittgenstein had discussed the issue in the Remarks on the (...) Foundations of Mathematics; his view had been that certain inferential practices are constitutive of our notions of thinking and inferring. I argue that his treatment of unfounded beliefs in On Certainty essentially replicates, mutatis mutandis, his treatment of basic logical inference. (shrink)

The purpose of this work is to provide an answer to two fundamental questions: 1) Can a non-alethic logic be a Meinongian logic? And consequently 2) Can a non-alethic logic be an adequate logic for a Meinongian theory of objects? Using the results of da Costa and da Costa & Marconi and furthermore of da Costa I propose a minimal non-alethic logic of the first order with identity and Hilbert’s "-symbol which can bring into Meinongian spirit (...) the most relevant aspects of Meinongian logic underlying Meinong’s theory of objects. This is just a first approach of mine, to account for a complex thought, but so interesting, too as Meinong’s thought. Furthermore, giving a positive answer to 1) and 2) I indicate a plausible way which can avoid both difficult approaches and the attempt to refuse the theory of objects in order to do not compromise standard logic and some of its own laws. Eva Picardi was a critic of both Chomskyan naturalism and Davidsonian semantic individualism. Though basically agreeing with her on both counts, I reject her identification of Chomsky’s notion of “tacit knowledge” of language with Dummett’s notion of implicit knowledge, and I argue that Eva’s criticism of the latter notion does not apply to the former. In the second part of the paper, I take Eva’s side in criticizing individualism, providing further reasons for the existence of a semantic standard and trying (...) to explain what it is and why we are committed to it. The "impure" indexicality of the pronoun we is exploited to widen or reduce its scope, depending on rhetorical expediency. This has powerful and mostly damaging effects on public discourse. In fact, collective identities are seldom precisely defined, and when they are they often turn out to be less discriminating than the “we” rhetoric assumes them to be.

Este artigo toma como ponto de partida um conjunto de cenas cinematográficas em que sujeitos deslocados, empobrecidos ou precarizados estão a dançar. Nestas cenas, a dança é um micro evento do cotidiano ou uma ação prosaica de pessoas comuns em filmes de cunho realista. No entanto, suspeita-se que este gesto banal ou ordinário de dançar é passível de ser investigado, a partir do que propõe Jacques Rancière, como um “momento qualquer” de emancipação fabulada. Assim, junto ao longa-metragem Bande de Filles (...) (Céline Sciamma, 2014), o artigo investiga como as cenas de dança figuradas pela imagem fílmica podem ser compreendidas enquanto um “momento qualquer” que irrompe as “hierarquias do tempo” e possibilita que os sujeitos “apareçam” de outra maneira que não aquela já indexada pelo regime da polícia. In classical logic, a contradiction allows one to derive every other sentence of the underlying language; paraconsistent logics came relatively recently to subvert this explosive principle, by allowing for the subsistence of contradictory yet non-trivial theories. Therefore our surprise to find Wittgenstein, already at the 1930s, in comments and lectures delivered on the foundations of mathematics, as well as in other writings, counseling a certain tolerance on what concerns the presence of contradictions in a mathematical system. ‘Contradiction. Why just this (...) spectre? This is really very suspicious.’ ( Philosophical Remarks III–56) In the last decades, several authors (e.g. Arrington, Hintikka, Van Heijenoort, Wright, Wrigley) have been digging into Wittgenstein’s rather non-standard standpoint on what concerns the interpretation and import of contradiction in logic and mathematics, and many other authors (e.g. da Costa, Goldstein, Granger, Marconi) have been investigating the possibility of taking Wittgenstein seriously as one of the early forerunners of paraconsistency. While many advances have been made on the first front, the second set of investigations has led almost exclusively to negative results: no, no operational proposal about the construction of a logic in which (some) contradictions are made inoffensive can be read from Wittgenstein’s philosophical work; in fact, it appears that the most one can find there is the exhortation for mathematicians to alter their attitude with respect to contradictions and to consistency proofs. The play is done, and one looks for a resume of the opera. This paper fills that blank, as a thorough investigation of the possible relations between Wittgenstein and paraconsistency. Em tempos de cultura digital, observa-se o acesso a uma quantidade incomensurável de informações sem que sejam feitas relações que poderiam transformá-las em conceitos. Uma vez que prevalece o uso instrumental de tais informações, arrefece concomitantemente a postura ética que o questiona. É nesse contexto que o professor ocupa um posto decisivo no que diz respeito à organização e à discussão de tais informações com seus alunos. Este artigo tem como objetivo argumentar que a postura de Pedro Goergen como educador (...) oferta aos alunos um tipo de relação que faz com que a própria figura do professor seja eticamente ressignificada nessa sociedade de cultura digital. Causal modelling provides a powerful set of tools for identifying causal structure from observed correlations. It is well known that such techniques fail for quantum systems, unless one introduces 'spooky' hidden mechanisms. Whether one can produce a genuinely quantum framework in order to discover causal structure remains an open question. Here we introduce a new framework for quantum causal modelling that allows for the discovery of causal structure. We define quantum analogues for core features of classical causal modelling techniques, including (...) the causal Markov condition and faithfulness. Based on the process matrix formalism, this framework naturally extends to generalised structures with indefinite causal order. (shrink)

Our purpose in this paper is to delineate an ontology for quantum mechanics that results adequate to the formalism of the theory. We will restrict our aim to the search of an ontology that expresses the conceptual content of the recently proposed modal-Hamiltonian interpretation, according to which the domain referred to by non-relativistic quantum mechanics is an ontology of properties. The usual strategy in the literature has been to focus on only one of the interpretive problems of the theory and (...) to design an interpretation to solve it, leaving aside the remaining difficulties. On the contrary, our aim in the present work is to formulate a “global” solution, according to which different problems can be adequately tackled in terms of a single ontology populated of properties, in which systems are bundles of properties. In particular, we will conceive indistinguishability between bundles as a relation derived from indistinguishability between properties, and we will show that states, when operating on combinations of indistinguishable bundles, act as if they were symmetric with no need of a symmetrization postulate. TRATA-SE DE UMA LEITURA QUE SE DEIXOU INSPIRAR, EM GRANDE MEDIDA, NAS INTERPRETAÇÕES DE FRIEDRICH KAULBACH E ANTONIO MARQUES.

This article considers why the influential neo-republicans Philip Pettit and Richard Bellamy tend to minimise or deny the role that natural or moral rights play in republican thought. It argues that their specific views about the theoretical role of such rights are motivated by methodological commitments. In Pettit’s case the commitments are to consequentialism and formalism, while in Bellamy’s it is to proceduralism. But these commitments get in the way of providing a fully adequate account of the value of freedom (...) as non-domination: one that allows us to determine when citizens actually enjoy this kind of freedom. Finally, the article argues that a full explanation of what it means to enjoy freedom as non-domination must unavoidably appeal to normative notions. (shrink)

In this paper, we present a formal interpretive account of Jean Piaget’s theory of the morality that regulates social exchanges, which we call interactional morality. First, we place Piaget’s conception in the context of his epistemological and sociological works. Then, we review the core of that conception: the two types of interactional moralities that Piaget identified to be usual in social exchanges, and the role that the notion of respect-for-the-other plays in their definition. Next, we analyze the main features of (...) social exchanges that are subject to each of those two types of interactional moralities. Following, we formalize Piaget’s account of how the two types of interactional moralities can be put to regulate social exchanges in which values, norms, beliefs, and goals are exchanged, so that interactional commitments can be established among the participants. Then, we sketch a moral reasoning system able to support formal reasonings about interactional moralities. Finally, we illustrate the usefulness of the overall formal model of interactional moralities that resulted from our study by applying it to the explication of some of the conclusions achieved by Piaget in his moral studies about children games. We apply the recently elaborated notions of ‘pragmatic truth’ and ‘pragmatic probability’ to the problem of the construction of a logic of inductive inference. It is argued that the system outlined here is able to overcome many of the objections usually levelled against such attempts. We claim, furthermore, that our view captures the essentially cumulative nature of science and allows us to explain why it is indeed reasonable to accept and believe in the conclusions reached by inductive inference.

Bonaventure is sometimes taken to be an ante litteram champion of the four-dimensional theory of persistence. I argue that this interpretation is incorrect: Bonaventure was no four-dimensionalist.

The article focuses on representing different forms of non-adjunctive inference as sub-Kripkean systems of classical modal logic, where the inference from □A and □B to □A ∧ B fails. In particular we prove a completeness result showing that the modal system that Schotch and Jennings derive from a form of non-adjunctive inference in (Schotch and Jennings, 1980) is a classical system strictly stronger than EMN and weaker than K (following the notation for classical modalities presented in Chellas, 1980). The unified (...) semantical characterization in terms of neighborhoods permits comparisons between different forms of non-adjunctive inference. For example, we show that the non-adjunctive logic proposed in (Schotch and Jennings, 1980) is not adequate in general for representing the logic of high probability operators. An alternative interpretation of the forcing relation of Schotch and Jennings is derived from the proposed unified semantics and utilized in order to propose a more fine-grained measure of epistemic coherence than the one presented in (Schotch and Jennings, 1980). Finally we propose a syntactic translation of the purely implicative part of Jaśkowski's system D₂ into a classical system preserving all the theorems (and non-theorems) explicilty mentioned in (Jaśkowski, 1969). The translation method can be used in order to develop epistemic semantics for a larger class of non-adjunctive (discursive) logics than the ones historically investigated by Jaśkowski. (shrink)

It is usually stated that quantum mechanics presents problems with the identity of particles, the most radical position—supported by E. Schrödinger—asserting that elementary particles are not individuals. But the subject goes deeper, and it is even possible to obtain states with an undefined particle number. In this work we present a set theoretical framework for the description of undefined particle number states in quantum mechanics which provides a precise logical meaning for this notion. This construction goes in the line of (...) solving a problem posed by Y. Manin, namely, to incorporate quantum mechanical notions at the foundations of mathematics. We also show that our system is capable of representing quantum superpositions. (shrink)

O presente trabalho tem por objetivo analisar a fábula “O gavião e o rouxinol”, presente na obra de Hesíodo Os Trabalhos e os Dias, destacando a intenção didática e pedagógica presente na fábula, a preocupação com a conduta ética e moral dos indivíduos que faziam parte daquela sociedade arcaica e campesina, da qual o próprio Hesíodo pertencia e, principalmente, justificar a importância da fábula como propósito exortativo e educacional de Hesíodo ao chamar a atenção de seu irmão mais novo Perses, (...) dos reis e dos poderosos donos de terras para o perigo da desmedida, do excesso, a hýbris, que o poeta qualifica como algo maléfico para todos. Pois, para Hesíodo, o indivíduo só se tornaria ético e valoroso através do trabalho (érgon) árduo da terra, que para ele era o único meio de sobreviver dignamente dentro das leis da Justiça de Zeus, a Díke.
